Zoning board upholds medical marijuana violation

SOUTH KINGSTOWN - A split decision by the South Kingstown Zoning Board to uphold a violation that zones a legal medical marijuana grow-site as an “agricultural manufacturing facility” will cost the lessee of the now-defunct Campus Cinema on Columbia Street up to $500 per day until the reported medical marijuana and growing equipment is removed from the site.
The original violation, sent by Building Official Jeffrey O’Hara on April 8, categorized the private medical marijuana operation at 17 Columbia St., as an agricultural manufacturing process when nothing else in the use code seemed to fit and he was “scrambling for a use that described it.”
The zoning board voted 3-2 to uphold the decision made by O’Hara, possibly creating a landmark on which to base further violations against the many medical marijuana growers in Rhode Island.
