State files suit over Misquamicut Beach access

Attorney General Peter Kilmartin has filed a lawsuit against six defendants with houses abutting Misquamicut Beach in an attempt to solidify beach access laws and erase “faulty” 1969 and 1970 survey plans that the state believes zoned the area incorrectly.

WESTERLY - Attorney General Peter Kilmartin has filed a lawsuit against six defendants with houses abutting Misquamicut Beach in an attempt to solidify beach access laws and erase “faulty” 1969 and 1970 survey plans that the state believes zoned the area incorrectly.

“This is the case of two faulty survey plans,” said the state’s summary of facts. “These drawings, made in 1969 and 1970, were respectively used by two individual beach-front owners to usurp the arrangements crafted six decades beforehand in the original subdivision. However, an established plat is not so easily uprooted.”
