NORTH KINGSTOWNâA group of residents, led by Colin OâSullivan and Rick L. Thompson, are continuing their Superior Court complaint with the town regarding the proposed mixed-use Rolling Greens development. The plans, amendments in the townâs Comprehensive Plan for which were approved in December 2012, have come under considerable opposition by residents who want to see the area preserved.
Last month, the town filed a motion to dismiss the complaint, which was turned down by the Superior Court judge, according to Thompson.
âWe were supposed to have another hearing approximately three weeks ago, and what happened was the town had asked for a delay,â said Thompson. âThey were going to seek another dismissal, so we applied for a motion of stay to prevent the developer from moving forward on any of the plans from the town.â
Judge Melanie Wilk Thunberg denied the motion for a stay this past Monday, but did state that any work done by developer Mark Hawkins would be subject to reversal if court proceedings in the future ruled against development.
âThe judge denied our motion for stay, but made it perfectly clear to the developer and town that any proceedings would be done at the developerâs own risk,â said Thompson. âWhat the town did not do is re-file for dismissal, so that opportunity is gone for them now. At this point, what our attorneys are doing is filing motions for discovery.â
In a letter sent this week to the stateâs Division of Statewide Planning, OâSullivan and Thompson claim that the process for approving the Comprehensive Plan, Land-Use and Water Service Area Maps to accommodate a new development at the Rolling Greens site on Route 102 was confusing to residents in the fall, among other complaints.
âThe North Kingstown Town Council is obligated by statute to protect the interests and well-being of town residents,â read the letter. âHowever, there have been multiple examples of this duty being neglected.â
